Terms of Service

1. Agreement to Terms
By downloading, installing, or using the Dasshh mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you and Dasshh LLC ("Dasshh," "we," "us," or "our").
2. Description of Service
Dasshh is a professional car service specializing in airport transportation, serving communities with reliable, pre-scheduled rides provided by professional drivers. When you book a ride through the Dasshh App, you are contracting directly with Dasshh LLC for transportation services. As the employer of its drivers, Dasshh is responsible for its drivers' performance of services in accordance with applicable law, subject to the limitations described in Section 14.

Insurance and Liability Coverage
All Dasshh vehicles carry commercial auto insurance that meets or exceeds the minimum coverage required by the State of Minnesota and all jurisdictions in which Dasshh operates. In the event of an accident or incident during a ride, Dasshh's commercial insurance policy provides coverage for bodily injury and property damage to riders, subject to the terms and limits of the applicable policy. 3. Eligibility
To use Dasshh, you must:

Be at least 18 years of age

Have a valid phone number capable of receiving SMS messages

Be able to form a binding legal agreement

Not be a person barred from receiving services under applicable law
If we discover or have reason to believe that a user is under 18 years of age, we will promptly terminate the account and delete all associated personal data. If you believe a minor has created an account, please contact us at support@dasshh.com.
4. Account Registration
Creating Your Account
You must register for an account to use the App. Registration requires:

A valid phone number (verified via one-time passcode)

Your first and last name

A home address
You may optionally provide an email address for receipts and communications.
SMS and Text Messages
By providing your phone number and creating an account, you consent to receive SMS text messages from Dasshh, including one-time passcodes for authentication, ride status updates, and driver communications. Message and data rates may apply depending on your mobile carrier plan. You may opt out of non-essential SMS messages at any time through the App's Settings, but you must receive authentication messages to use the App.
Account Security
You are responsible for maintaining the security of your account and phone number. You must immediately notify us at support@dasshh.com if you suspect unauthorized use of your account. Dasshh is not liable for losses arising from unauthorized access to your account.
One Account Per Person
Each person may maintain only one Dasshh account. Creating multiple accounts may result in suspension or termination of all associated accounts.
5. Booking and Rides
Requesting a Ride
When you request a ride through the App, you will receive a fare estimate based on the pickup location, destination, service type, and distance. Fare estimates are not guaranteed and the final fare may vary based on actual route, wait time, or other factors.
Pricing
Fares are determined based on factors including distance, service type, time of day, and demand. Fare details and any applicable pricing adjustments will be disclosed to you in the App before you confirm a booking.
Service Areas
Dasshh operates in designated service areas. The App will notify you if your requested pickup or destination is outside a current service area. Service areas may change at any time.
Scheduled Rides
Dasshh specializes in pre-scheduled rides. When you schedule a ride, Dasshh will make reasonable efforts to assign a driver and fulfill the ride at the requested time. However, ride fulfillment is subject to driver availability and is not guaranteed.
Driver Assignment
Drivers are assigned by Dasshh's dispatch team. You may not select a specific driver for a given ride, though Dasshh may offer driver preference features in the future.
Accessibility
Dasshh is committed to providing accessible transportation services and strives to comply with the Americans with Disabilities Act (ADA) and applicable state and local laws. Service animals are welcome in all Dasshh vehicles at no additional charge. If you require a wheelchair-accessible vehicle or other reasonable modifications, please indicate this when booking or contact us at support@dasshh.com. 6. Cancellation Policy
You may cancel a ride at any time through the App. The following policies apply:

Before driver assignment: No cancellation fee.

After driver assignment: A cancellation fee may apply if the driver has already begun traveling to your pickup location. The fee amount, if any, will be displayed before you confirm cancellation.

No-shows: If you are not present at the pickup location when the driver arrives and cannot be reached, the ride may be marked as a no-show. A no-show fee may apply.
Dasshh reserves the right to modify the cancellation policy with reasonable notice.
7. Payments
Payment Authorization
By requesting a ride, you authorize Dasshh to charge the payment method on file for the fare, applicable fees, tolls, and any tips you choose to add. Payment is processed through Stripe, a third-party payment processor. Your use of Stripe is subject to Stripe's terms of service.
Payment Hold
When you book a ride, a temporary hold may be placed on your payment method for the estimated fare amount. The final charge will reflect the actual fare upon ride completion.
Tips
After a ride is completed, you may tip your driver through the App. Tips are optional and 100% of tip amounts go directly to the driver. Tips may be submitted up to 30 days after ride completion.
Receipts
A receipt will be available in the App after each completed ride. If you have provided an email address, a receipt may also be sent via email.
Failed Payments
If your payment method is declined or fails after a ride is completed, Dasshh reserves the right to attempt to charge the payment method on file again, charge an alternative payment method associated with your account, or suspend your account until the outstanding balance is resolved. You remain responsible for all charges incurred through your account, including any fees resulting from failed payment attempts.
Disputed Charges
If you believe a charge is incorrect, contact us at support@dasshh.com within 60 days of the charge. We will review and respond to disputes promptly. This policy does not limit any rights you may have under applicable law or your credit card issuer's chargeback policies.
8. User Conduct
You agree not to:

Provide false or misleading information during registration or booking

Use the App for any unlawful purpose

Harass, threaten, or behave disrespectfully toward drivers or Dasshh staff

Damage or soil a Dasshh vehicle
-
Transport illegal substances, weapons, or hazardous materials

Use the App to arrange rides for unaccompanied minors (under 18)

Attempt to defraud Dasshh, drivers, or other users
-
Interfere with the App's operation, security, or infrastructure
-
Share your account credentials with others or allow others to use your account
Violation of these rules may result in suspension or permanent termination of your account.
9. User-Generated Content
If you submit ratings, reviews, feedback, or other content through the App ("User Content"), you grant Dasshh a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display such User Content for the purpose of operating and improving the App and our services. You represent that you own or have the right to submit any User Content you provide and that it does not violate any third-party rights.
Dasshh reserves the right to remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.
10. Account Deletion
You may delete your account at any time through the App's Settings screen. When you request account deletion:

Your personal data will be removed from our systems within 30 days, including your profile, ride history, and stored payment methods

Any outstanding payments must be settled before deletion

Account deletion is irreversible
Dasshh may retain certain data after account deletion as required by law, including records necessary for tax compliance, fraud prevention, regulatory requirements, or the resolution of pending disputes or legal claims. Any retained data will be kept only for as long as required and will not be used for other purposes.

11. Intellectual Property
The Dasshh name, logo, and brand identity are the property of Dasshh LLC. The App design and underlying software are provided under license and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without prior written consent.
Your use of the App grants you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose on a personal device.
12. Privacy and Location Data
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.
Location Data
The App collects precise location data from your device to provide core functionality, including determining your pickup location, displaying nearby drivers, tracking rides in progress, and calculating fares. Location data is collected when you use the App and may be collected in the background during an active ride. You can control location permissions through your device settings, but disabling location access may prevent the App from functioning properly. 13. Disclaimer of Warranties
THE APP AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
DASSHH DOES NOT WARRANT THAT:

THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
-
RIDES WILL BE AVAILABLE AT ALL TIMES OR IN ALL AREAS
-
FARE ESTIMATES WILL EXACTLY MATCH FINAL CHARGES
-
TRAVEL TIMES OR ARRIVAL ESTIMATES WILL BE ACCURATE
TO THE EXTENT ANY DESCRIPTION OF OUR SERVICES IN THESE TERMS OR IN THE APP COULD BE INTERPRETED AS A WARRANTY, SUCH DESCRIPTION IS ASPIRATIONAL AND DOES NOT CONSTITUTE A GUARANTEE OF PERFORMANCE OR AVAILABILITY.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DASSHH LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO MISSED FLIGHTS, LOST LUGGAGE, OR DELAYS.
NOTHING IN THIS SECTION SHALL LIMIT DASSHH'S LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY THE NEGLIGENCE OF DASSHH OR ITS EMPLOYEES, INCLUDING DRIVERS; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
SUBJECT TO THE FOREGOING, DASSHH'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID TO DASSHH IN THE 12 MONTHS PRECEDING THE CLAIM, OR (II) $1,000.
15. Indemnification
You agree to indemnify and hold harmless Dasshh LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use of the App

Your violation of these Terms

Your violation of any third-party rights

Your conduct during a ride
16. Dispute Resolution
Informal Resolution
Before filing any formal legal action or initiating arbitration, you agree to contact us at support@dasshh.com and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration
If we cannot resolve a dispute informally, you and Dasshh agree to resolve any claims arising from or relating to these Terms or the App through final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will take place in Hennepin County, Minnesota, or at another mutually agreed location. The arbitrator's decision will be binding and may be entered as a judgment in any court of competent jurisdiction.
Filing, administration, and arbitrator fees will be allocated in accordance with AAA Consumer Arbitration Rules. Each party will bear its own attorneys' fees unless the arbitrator awards them to the prevailing party.
Small Claims Court Exception
Notwithstanding the above, either party may bring an individual action in small claims court in Hennepin County, Minnesota (or the small claims court with jurisdiction over your residence), as an alternative to arbitration, provided the claim falls within the court's jurisdictional limits.
Class Action and Jury Trial Waiver
YOU AND DASSHH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. YOU AND DASSHH WAIVE ANY RIGHT TO A JURY TRIAL.
If the class action waiver in this section is found to be unenforceable as to a particular claim or request for relief, then that claim or request for relief shall be severed and proceeded with in a court of competent jurisdiction, while remaining claims shall continue in arbitration.
Opt-Out of Arbitration
You may opt out of this arbitration agreement by sending written notice to support@dasshh.com within 30 days of creating your account. Your notice must include your name, phone number, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, the Governing Law and Jurisdiction provisions below will apply to any disputes.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict of law principles.
Jurisdiction
For disputes not subject to arbitration, any legal proceedings arising from these Terms shall be brought exclusively in the state or federal courts located in Hennepin County, Minnesota.
17. Force Majeure
Dasshh shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond Dasshh's reasonable control, including but not limited to: severe weather, natural disasters, pandemics, epidemics, acts of God, government actions or restrictions, airport closures, road closures, civil unrest, strikes, power outages, internet or telecommunications failures, or cyberattacks. During a force majeure event, Dasshh will make reasonable efforts to notify affected riders and resume normal service as soon as practicable.
18. Modifications to Terms
Dasshh may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect, through the App or via the contact information associated with your account. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the App and may delete your account.
19. Termination
Dasshh may suspend or terminate your account at any time for cause, including but not limited to:

Violation of these Terms

Fraudulent or illegal activity

Conduct that endangers drivers, other users, or Dasshh staff
-
Extended period of account inactivity (12 months or more)
Dasshh will provide notice of termination when reasonably practicable, unless immediate termination is necessary to protect the safety of drivers, riders, or staff, or to prevent fraud or illegal activity.
Refunds Upon Termination
If your account is terminated and you have pre-paid for scheduled rides that have not yet been fulfilled, you are entitled to a refund of any unused, pre-paid amounts. Contact support@dasshh.com to request a refund.
Survival
Upon termination, your right to use the App ceases immediately. Sections 7 (Payments), 9 (User-Generated Content), 11 (Intellectual Property), 13 (Disclaimer of Warranties), 14 (Limitation of Liability), 15 (Indemnification), 16 (Dispute Resolution), and this section survive termination.
20. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dasshh regarding use of the App.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. If the class action waiver in Section 16 is found unenforceable as to a particular claim, that claim shall be severed and resolved in court while remaining claims proceed in arbitration.

Waiver. Failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment. You may not assign your rights under these Terms. Dasshh may assign its rights in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets, subject to any required regulatory approvals and upon notice to you.

Notices. Dasshh may provide notices to you through the App, via SMS to your registered phone number, or via email if you have provided one.

Electronic Agreement. You acknowledge that by creating an account and using the App, you are entering into these Terms electronically, and that your electronic acceptance constitutes a binding agreement under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN), the Uniform Electronic Transactions Act (UETA), and any applicable state laws governing electronic transactions.

Third-Party Beneficiaries. These Terms do not create any third-party beneficiary rights. No person or entity other than you and Dasshh has any rights under these Terms.

Governing Language. These Terms are drafted in English. If these Terms are translated into any other language, the English-language version shall control in the event of any conflict.
